The Warning-Letter Waves
Last updated: October 18, 2026
The FDA’s main tool against the peptide gray market, short of criminal referral, is the warning letter: a formal notice that a seller’s products are unapproved drugs being marketed in violation of federal law. Letters are regulatory notices stating the agency’s position — they are not court findings. But they create the record on which later prosecutions, like Paradigm Peptides, are built. Paradigm itself received letters in 2020 and 2022 before its owner went to prison.
Wave One — December 2024
- Xcel Peptides
- SwissChems
- Summit Research
- Prime Peptides
Wave Two — February 2025
- USA Peptide
Wave Three — August 24, 2026
- Royal Peptides
- Peptide Partners
- NuScience
- Peak Performance
- Tex Peptides
The Agency’s Theory
Across the waves, the FDA’s argument is consistent: a “research use only” label does not control the analysis. Intended use is proven by conduct — publishing dosing guides and calculators, selling bacteriostatic water and other injection supplies alongside the compounds, and marketing benefits to consumers. On that record, the agency treats the products as unapproved drugs intended for human use, full stop.
Warned — and Still Advertising
Enforcement attention has not emptied the market. Public Citizen found that 11 of 14 sellers who received FDA warning letters over retatrutide — an experimental compound that has never been approved anywhere — were still advertising it months later. The letters, in other words, are the beginning of the process, not the end. Sellers who ignore them are building the paper trail for the next Paradigm-style case.
The Wider Enforcement Picture
- No standalone FTC action exists. Despite frequent claims online, peptide enforcement is FDA/DOJ plus private litigation — do not let anyone tell you the FTC has blessed or banned anything here.
- Eli Lilly filed six lawsuits in August 2026 against sellers trading on its GLP-1 brands and has referred more than 200 sellers for enforcement.
- State attorneys general have petitioned over counterfeit peptides (40+ states), and a separate 20-state letter led by Alabama AG Marshall (September 18, 2026) targeted Chinese suppliers.
- Border seizures are running in parallel: roughly 130,000 vials seized by CBP between October 2025 and August 2026.
