Thirty-Five Years of a Dead Husband’s Benefits — Charged
Prosecutors allege Gail Starks collected her late husband’s survivor benefits from 1991 to 2026 — concealing a remarriage that ended eligibility — and lied about being married when the VA finally asked in August 2026. $397,120. Indicted, not convicted.
The indictment alleges that from June 1991 through August 2026 — thirty-five years — Starks knowingly stole Dependency and Indemnity Compensation spousal-support benefits from the VA. DIC eligibility for a surviving spouse generally ends on remarriage, the fact prosecutors say she concealed.
On August 11, 2026, when her eligibility was investigated, she allegedly told a VA employee she was not married when in fact she was married, adding a false-statement count.
The United States is seeking forfeiture of $397,120 as proceeds of the alleged theft. VA OIG investigated. These are charges only; Starks is presumed innocent.
