1,600 Theft Allegations, and the VA Couldn’t Keep the Dates Straight
The OIG reviewed about 1,600 fiduciary misuse allegations. Staff recorded the wrong start date in an estimated 22% of cases, an estimated 240 allegations that should have been investigated were closed without one — and nobody at the national level was watching for any of it.
The VA Office of Inspector General reviewed whether fiduciary program staff in the Veterans Benefits Administration handled about 1,600 misuse allegation cases — completed from April 2024 through March 2025 — the way the program's own guidance requires. Properly recording and investigating credible allegations is how the VA stops financial abuse and reimburses misused benefits to the beneficiaries they belong to.
The OIG found staff did not always accurately record the earliest date a misuse allegation was received: its statistical estimate put the wrong date in about 350 cases, roughly 22%, with an average discrepancy of at least 19 days — one case was recorded 110 days after the allegation arrived, another 214 days late. Dates matter because they start the clock on protecting the beneficiary.
Nor were allegations consistently advanced for investigation. Of an estimated 960 cases in which staff decided an investigation was unnecessary, the OIG concluded about 240 — 25% — should have been investigated under the program manual. And there was no systematic national monitoring of misuse allegations to detect staff's missteps.
The OIG attributed the failures to unclear language in the VA Fiduciary Program Manual, confusion about the evidentiary threshold for opening an investigation, and staff applying provisions meant for other parts of the fiduciary process. It made four recommendations; the principal deputy under secretary for benefits concurred with all four, and the OIG has already closed one of them.
